اعتراض بزرگترين انجمن مطالعات خاورميانه

به حکم اعدام دکتر آغاجری

* هدف کسانی که چنين احکامی را صادر کرده اند، تنها مجازات دکتر آغاجری نمی باشد، بلکه برای ترساندن ساير دانشگاهيان و متفکران از بيان عقايدشان است

* ما از شما می خواهيم که فورا و بدون هيچ قيد و شرطی دکتر آغاجری آزاد شود

مدير اجرايی «انجمن مطالعات خاورميانه در آمريکای شمالی (MESA)» در نامه ای به آيت الله خامنه ای نگرانی عميق خود و اعضای اين انجمن را نسبت حکم اعدام دکتر آقاجری استاد دانشگاه تربيت مدرس اعلام نمود وآن را قويا محکوم کرد.

انجمن مطالعات خاورميانه در آمريکای شمالی (MESA) بيش از ۲۷۰۰ عضو دانشگاهی در سراسر جهان دارد. برگردان فارسی اين نامه همراه با متن اصلی آن را در زير می خوانيد:

من اين اعتراضيه را از طرف کميته ی آزادی های علمی و دانشگاهی انجمن مطالعات خاورميانه در آمريکای شمالی (MESA) برای شما می نويسم. ما بدين وسيله می خواهيم مراتب نگرانی عميق خود را از حکم اعدام و ساير احکام سنگينی که عليه پرفسور هاشم آغاجری، رئيس کرسی تاريخ دانشگاه تربيت مدرس و استاد مهمان دانشگاه تهران و دانشگاه بهشتی صادر شده است، ابراز داريم و آن را قويا محکوم کنيم.

انجمن مطالعات خاورميانه در شمال آمريکا (MESA) که دارای ۲۷۰۰ عضو دانشگاهی از سراسر جهان است ، برجسته ترين تشکل آکادميک در زمينه ی تدريس و پژوهش درباره ی خاورميانه و شمال افريقا می باشد. اين انجمن که مجله ی بين المللی خاورميانه را منتشر می کند، خود را متعهد و تضمين کننده احترام به اصول آزادی علمی و آزادی بيان در منطقه و در ارتباط با مطالعات خاورميانه و شمال آفريقا می داند.

به موجب اطلاعاتی که دريافت داشته ايم ، پرفسور آغاجری پس از يک سخن رانی که در همدان زير عنوان "پروتستانيسم اسلامی" ايراد کرد، در ماه اوت متهم به شرک گرديد و دستگير شد. گفته می شود که دکتر آغاجری در آن سخن رانی نقش سياسی دستگاه روحانيت را مورد انتقاد قرار داده و خواستار پايان بخشيدن به "تقليد کورکورانه " از احکام و فتواهای رهبران روحانی شده است.

در پی محاکمه ی غير عادلانه دادگاه همدان که در پشت درهای بسته انجام گرفت ، قاضی رمضانی در هفتم نوامبر، پرفسور آغاجری را به اعدام محکوم کرد. قاضی او را به هفتادوچهار ضربه شلاق و هشت سال زندان و ده سال محروميت از تدريس نيز محکوم کرد.

ما می دانيم هنگامی که رسما اين احکام به وکيل مدافع آغاجری ابلاغ گردد، او بيست روز فرصت دارد که از دادگاه عالی فرجام خواهی کند. به نظر ما محکوميت سنگين پرفسور آغاجری صرفا به خاطر استفاده از حق آزادی بيان بوده است که در بند ۱۹ منشور جهانی حقوق مدنی و سياسی تضمين شده است. ايران به عنوان دولتی که به اين منشور ملحق شده است ، موظف به احترام و حفاظت اين حق است.

آشکار است که در جريان تحولات سياسی کنونی ايران ، هدف کسانی که چنين احکامی را صادر کرده اند، تنها مجازات دکتر آغاجری ، استادی که به خاطر شجاعت و پاکی اش مورد احترام همگانی است ، نمی باشد، بلکه برای ترساندن ساير دانشگاهيان و متفکران از بيان عقايدشان است.

بنابراين ما از شما با قوی ترين کلمات ممکن می خواهيم که به طور علنی عليه احکام موضع گرفته و از هرگونه اقدام لازم جهت جلوگيری از اجرای حکم اعدام و هرگونه مجازات ديگر عليه پرفسور آغاجری کوتاهی نکنيد. ما از شما می خواهيم که از رئيس قوه ی قضائيه و ساير مقامات مربوطه خواسته شود که فورا و بدون هيچ قيد و شرطی دکتر آغاجری آزاد شود و محروميت تدريس او لغو گردد.

ما همچنين می دانيم که دکتر آغاجری نياز فوری به مراقبت پزشکی دارد. پای راست او که از زانو به علت جراحات وارده در جنگ عراق و ايران در دهه ی ۱۹۸۰ قطع شده بود، دجار عفونت گرديده است.

بايستی پرفسور آغاجری فورا تمام مراقبت های پزشکی را با انتخاب پزشک از سوی خودش در دسترس داشته باشد.

عاليجناب:

اين اقدامات برای اعاده ی حيثيت حهانی ايران به مثابه ی کشوری با پيشينه ديرين انديشه و جستار علمی و برای اطمينان از بهره مندی ايرانيان از آزادی تبادل افکار و انديشه ضرورت دارد. ما پيشاپيش از توجه شما به اين مسائل سپاسگزار و در انتظار پاسخ هستيم.

Your Excellency:

I am writing to you on behalf of the Committee on Academic Freedom of the
Middle East Studies Association of North America (MESA). We are contacting
you to express our very grave concern and strong condemnation regarding
the death sentence and other harsh penalties issued against Professor
Hashem Aghajari, chair of the history department at Tehran's Tarbiat
Modaress University and a visiting professor at the University of Tehran
and Beheshti University.

The Middle East Studies Association of North America (MESA) comprises 2700
academics worldwide who teach and conduct research on the Middle East and
North Africa, and is the preeminent professional association in the field.
The association publishes the International Journal of Middle East
Studies, and is committed to ensuring respect for the principles of
academic freedom and freedom of expression in the region and in connection
with the study of the Middle East and North Africa.

According to information we have received, in August Professor Aghajari
was arrested and charged with apostasy following a lecture he delivered in
the city of Hamedan entitled "Islamic Protestantism." In those remarks he
reportedly criticized the political role of Iran's clerical establishment
and called for an end to "blind obedience" to decrees by clerical leaders.
Following an unfair trial in the Hamedan District Court that was closed to
the public, Judge Ramazani on November 7 condemned Professor Aghajari to
death. The judge also sentenced him to seventy-four lashes and eight years
in prison and proclaimed a ten-year ban against his engagement in teaching
activities.

We understand that once this ruling is formally conveyed to Professor
Aghajari's legal counsel, he will have twenty days in which to appeal the
sentence to the Supreme Court.

It is our view that Professor Aghajari is being prosecuted and harshly
punished solely for exercising his right to freedom of expression as
guaranteed under Article 19 of the International Covenant on Civil and
Political Rights. Iran, as a state party to this treaty, is obligated to
respect and protect the exercise of this right.

In the context of current political developments in Iran, it is apparent
that the intent of those who brought these charges and arrived at this
judgement is not only to punish Dr. Aghajari, an academic respected in
Iran for his courage and integrity, but also to intimidate other academics
and public thinkers from speaking out.

We therefore urge you in the strongest terms to speak out publicly and to
take all necessary steps to ensure that neither the death penalty nor any
of the other punishments decreed against Professor Aghajari are carried
out. We ask that you request the head of the Judiciary and other relevant
officials to release Professor Aghajari from prison immediately and
unconditionally, and lift the ban against his teaching activities.

We also understand that Dr. Aghjajari is in urgent need of medical
attention regarding an infection that has developed in his right leg,
which had been amputated at the knee following injuries received in the
1980s during the Iran-Iraq war. We ask that you take urgent steps to
ensure that Dr. Aghajari receives immediately all necessary medical
attention and has access to medical professionals of his choosing.

Your Excellency, these steps are critical in order to help restore Iran's
international standing as a country with a great tradition of learning and
scholarly inquiry, and to ensure that Iranian society benefits from the
free exchange of ideas. We thank you in advance for your attention to this
matter and look forward to your reply.
